Trade Mark Search

The reasons for undertaking a trade mark search are:

  • for registrability purposes – to assess whether your mark can be registered with IP Australia in the face of previously existing marks on the register or in the marketplace; or
  • for infringement purposes – to assess whether your brand or trade mark does, or will, infringe another party’s trade mark

In most situations McIntoshIP recommends conducting a trade mark search prior to applying for a new trade mark. We offer two types of searches:

  • Exact Name Search ($150)
    • search of the Australian Trade Mark Register
  • Trade Mark Search ($300)
    • search of the Australian Trade Mark Register
  • Comprehensive Trade Mark Search ($450)
    • search of the Australian Trade Mark Register, company and business name search, foreign dictionary search, Pharmaceutical Names Index, MIMS and Search For Australian Surnames (SFAS) database.

Each search is issued with a report including a summary of our advice.
